TERMS OF USE

These Terms of Use (“Terms”) are a binding agreement between you and Drake Media LLC, doing business as Drake Magazine (“Drake Magazine,” “we,” “our,” or “us”). They govern your access to and use of drakesmagazine.com and any related content, services, features, and digital experiences we make available through the website (collectively, the “Website”).

By accessing or using the Website, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Website. Additional terms may apply to particular services, purchases, submissions, events, promotions, or other features and will become part of your agreement with us when applicable.

The Website and its materials are owned by or licensed to Drake Magazine and are protected by applicable intellectual-property laws. Site materials include articles, editorials, interviews, graphics, illustrations, branding, logos, photography, video, audio, layouts, designs, compilations, databases, and other content appearing on the Website.

Except for rights expressly granted in these Terms, Drake Magazine and its licensors retain all rights in the Website and its materials. Nothing on the Website transfers ownership of any content or intellectual property to you.

Subject to these Terms, Drake Magazine grants you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Website for lawful, personal, noncommercial purposes.

You may not reproduce, republish, distribute, sell, license, modify, create derivative works from, publicly display, systematically download, scrape, frame, or commercially exploit Website materials unless Drake Magazine has given prior written permission or applicable law expressly permits the use.

DRAKE MAGAZINE, associated names, logos, slogans, trade dress, and other brand features are trademarks or other protected identifiers of Drake Media LLC. You may not use them in a way that suggests sponsorship, endorsement, affiliation, or approval without written permission.

Requests to reproduce, distribute, display, adapt, syndicate, or otherwise reuse Drake Magazine content should be submitted through our Licensing & Reuse of Content page. Permission is not granted unless confirmed in writing by an authorized representative of Drake Magazine.

If you believe material on the Website infringes a copyright you own or control, send a written notice to Drake Magazine’s designated copyright agent containing: identification of the copyrighted work claimed to be infringed; identification and location of the allegedly infringing material; your name and reliable contact information; a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or law; a statement, made under penalty of perjury, that the notice is accurate and you are authorized to act for the copyright owner; and your physical or electronic signature.

A person who knowingly makes a material misrepresentation in a notice or counter-notice may be liable under applicable law. Drake Magazine may remove or disable access to challenged material and may notify the person who provided it. Counter-notices must satisfy applicable statutory requirements.

The Website may allow you to send story ideas, comments, photographs, videos, event information, business information, applications, or other materials (“User Content”). You retain ownership of your User Content.

When you submit User Content, you grant Drake Magazine a non-exclusive, worldwide, royalty-free license to receive, store, review, reproduce, format, and use that content only as reasonably necessary for the purpose for which it was submitted, to administer the relevant feature, and to evaluate or respond to the submission. Any broader publication or commercial use may be governed by a separate written agreement, release, or permission.

You represent that you have the rights needed to submit the User Content and that our permitted use will not violate another person’s rights. Submission does not guarantee publication, payment, employment, partnership, placement, or a response.

You may not use the Website to violate law; threaten, harass, defame, or maliciously target others; impersonate another person; invade privacy; disclose confidential information without authority; distribute malware; interfere with Website security or operation; attempt unauthorized access; or submit content you do not have the right to share.

These rules do not prohibit honest opinions, good-faith criticism, lawful commentary, or legitimate consumer reviews. Disagreement with Drake Magazine, an advertiser, a business, or another user does not by itself violate these Terms.

Drake Magazine may review, edit, decline, restrict, or remove User Content when we reasonably believe it violates these Terms, applicable law, another person’s rights, or the integrity of our services. We may preserve or disclose content when required by law or reasonably necessary to protect rights, safety, or security.

We are not obligated to monitor every submission or communication and do not guarantee that all objectionable content will be identified or removed.

If Drake Magazine offers accounts, memberships, or registration features, you must provide accurate information, keep your credentials confidential, and promptly update information that changes. You are responsible for activity under your account unless caused by our failure to use reasonable security measures.

We may require verification, reject a registration, or suspend an account consistent with these Terms. Additional membership or subscription terms will be presented before you enroll where applicable.

The Website is intended for a general audience and is not directed to children under 13. You must meet any age or eligibility requirements stated for a transaction, contest, giveaway, event, account, or other feature.

If you are not old enough to enter a binding contract in your jurisdiction, a parent or legal guardian must authorize transactions or other activities that require consent.

The Website may contain advertising, sponsored content, paid partnerships, affiliate links, or other commercial relationships. Drake Magazine will identify these relationships where disclosure is required and seeks to keep editorial judgment distinct from commercial arrangements.

Opinions expressed by authors, interviewees, contributors, or advertisers are their own and do not necessarily reflect the views of Drake Magazine. A paid relationship does not guarantee a favorable editorial opinion.

The Website may link to or display content, products, platforms, ticketing services, social networks, or services operated by third parties. Links are provided for convenience or context and do not by themselves imply endorsement, sponsorship, or responsibility.

Third parties control their own content, availability, security, terms, and privacy practices. Review those terms before using a third-party service or providing it with information.

Events, contests, giveaways, sweepstakes, and promotions may be governed by separate official rules, eligibility requirements, releases, deadlines, and restrictions. Those specific terms control if they conflict with these general Terms.

Submitting an entry or registering does not guarantee admission, selection, a prize, publication, or participation. Void where prohibited.

If Drake Magazine offers magazines, subscriptions, merchandise, tickets, or other products or services for purchase, prices, availability, fulfillment details, renewal terms, refund terms, taxes, shipping, and other material conditions will be presented at or before checkout where applicable.

We may correct genuine pricing or description errors, decline or cancel an order when reasonably necessary, and issue an appropriate refund for amounts paid for an unfulfilled cancelled order. Payment processors and fulfillment providers may apply their own terms.

Advertising, sponsorship, creative-services, directory, event, and business inquiries are requests for consideration only. Sending an inquiry does not create a contract, reserve inventory, guarantee acceptance, or require Drake Magazine to provide services.

Any engagement is subject to availability, review, agreed pricing, campaign specifications, and a separate written agreement or insertion order where appropriate.

When you provide contact information and affirmatively request communications, you consent to receive the communications described at the point of collection. Message and data rates may apply to mobile communications.

You may withdraw consent to marketing emails through the unsubscribe link in those messages and may use any stated stop or opt-out mechanism for text messages. Consent to marketing is not a condition of purchase unless clearly stated and permitted by law. We may still send necessary transactional, service, or legal notices.

Downloads, media kits, forms, guides, digital issues, and other materials made available through the Website remain subject to these Terms and any additional notice accompanying the material.

A download does not transfer ownership or grant permission for redistribution, resale, removal of rights notices, or uses beyond the scope expressly stated.

The Website is provided on an as-available basis. We may maintain, update, suspend, withdraw, or change features or content and cannot promise uninterrupted or error-free access.

Editorial, lifestyle, travel, business, health, financial, legal, and other information is provided for general informational purposes and is not a substitute for advice from a qualified professional. Nothing in these Terms excludes a warranty or right that applicable law does not allow us to exclude.

To the extent permitted by law, Drake Magazine and its officers, employees, contributors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the Website when such damages were not reasonably foreseeable.

We do not limit liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or any liability that cannot lawfully be limited. Your rights may vary by jurisdiction.

To the extent permitted by law, you agree to indemnify Drake Media LLC against third-party claims, losses, and reasonable costs directly arising from your unlawful use of the Website, your material breach of these Terms, or User Content that you submitted without necessary rights.

This obligation applies only to the extent you are responsible for the conduct at issue. Drake Magazine will provide reasonable notice of a covered claim and will not settle a claim in a way that imposes non-monetary obligations on you without your consent.

Drake Magazine may suspend or restrict access when reasonably necessary to address unlawful activity, material breaches of these Terms, security threats, harm to others, misuse of services, or operational needs.

Where practical, we may provide notice or an opportunity to address the issue. Provisions that by their nature should survive termination—including ownership, permitted licenses already granted, disclaimers, liability limits, and dispute provisions—will survive.

Drake Magazine operates the Website from the United States. We make no representation that the Website or every feature is appropriate or available in every location.

If you access the Website from another jurisdiction, you are responsible for complying with local laws that apply to you, subject to rights that cannot be waived.

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Before filing a formal claim, you and Drake Magazine are encouraged to contact one another and make a good-faith effort to resolve the concern informally. Either party may pursue available remedies under applicable law if informal efforts do not resolve the matter.

These Terms do not require mandatory arbitration and do not waive any right to participate in a class or collective action that applicable law otherwise permits. Any court proceeding will be handled in a court with lawful jurisdiction and venue.

If a court finds any provision of these Terms unlawful or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect.

A failure or delay by Drake Magazine in exercising a right under these Terms does not waive that right. A waiver is effective only if made in writing by an authorized representative and applies only to the specific circumstances stated.

You may not assign your rights or obligations under these Terms without our prior written consent. Drake Media LLC may assign these Terms in connection with a merger, reorganization, financing, sale of assets, or transfer of the Website or relevant business, provided the successor remains responsible for applicable obligations.

We may update these Terms to reflect changes in the Website, our practices, or applicable law. The revised Terms will be posted here with an updated date.

When changes are material, we will provide additional notice where reasonably appropriate or legally required. Continued use after revised Terms take effect constitutes acceptance of the updated Terms; changes do not retroactively alter disputes that arose before their effective date unless both parties agree or law requires otherwise.

These Terms, the Privacy Policy, and any applicable additional terms presented for a specific service form the agreement between you and Drake Magazine concerning the Website and supersede prior understandings about that subject.

If specific additional terms conflict with these Terms, the specific terms control for that feature, transaction, promotion, submission, or service.
